1. General Provisions
1.1. This document is a public offer in accordance with Articles 435 and 437 of the Civil Code of the Russian Federation.
1.2. The Offer is addressed to individuals and defines the terms of service for the Rhiza Vision service (hereinafter — the Service).
1.3. Service Provider: LLC "ABM-II" (OOO "ABM-II"), OGRN 1230200004550, INN 0278976356, address: 450006, Republic of Bashkortostan, Ufa, Lenin st., 162.
2. Terms
Service — software product Rhiza Vision and related interfaces designed for generating visualizations from user-uploaded data.
User — an individual using the Service.
Service (in this context) — provision of access to visualization generation functionality within the paid volume.
3. Acceptance of Offer
3.1. Before payment, the User familiarizes themselves with this Offer and the Privacy Policy.
3.2. Acceptance of the Offer is the successful payment of the selected service package in the Service interface.
3.3. From the moment of acceptance, the Offer is considered a contract between the Service Provider and the User.
4. Subject of the Contract
4.1. The Service Provider grants the User access to the Service functionality for generating visualizations under the terms of this Offer.
4.2. The specific volume of available generations, cost and other parameters are indicated in the Service interface at the time of payment.
5. Cost and Payment Terms
5.1. Service cost is determined by current Service tariffs.
5.2. Payment is made through the ЮKassa payment service using available methods (including bank card and/or SBP).
5.3. Payment is considered completed after the Service Provider receives confirmation of successful payment from the payment provider.
6. Service Provision Procedure
6.1. To receive the result, the User sends source data through the Service interface.
6.2. The service for a specific generation is considered provided from the moment the result is provided in the Service interface.
6.3. In case of technical failure resulting in no generation result, the Service Provider may restore the deducted generation volume.
7. Refund Policy
7.1. Refund requests are sent by the User to support: support@rhizalab.ru.
7.2. The primary resolution method is restoration of generation volume and/or partial refund for unused volume.
7.3. If the service has been provided and the result delivered to the User, monetary refund is generally not made.
7.4. Upon approval, refunds are made using the same payment method.
7.5. Refund period after request approval — up to 10 calendar days.
8. Rights and Obligations
Service Provider obligated to: provide access to the Service, except during maintenance; process personal data in accordance with RF legislation.
User obligated to: provide lawful and correct source data; not use the Service for illegal purposes; not upload materials violating third party rights.
Service Provider has the right to restrict access to the Service if the User violates the Offer terms.
9. Liability
9.1. The Service is provided "as is" considering technological limitations.
9.2. The Service Provider does not guarantee full compliance of the result with the User's subjective expectations.
9.3. The Service Provider is not liable for damages arising from: User providing incorrect source data; third party actions; failures in external services.
10. Intellectual Property
10.1. Exclusive rights to the Service, its program code, design and other elements belong to the Service Provider.
10.2. The User receives the right to use generation results within limits not contradicting RF legislation.
11. Personal Data
11.1. Personal data processing conditions are defined in the Privacy Policy: https://rhizalab.ru/privacy.
12. Offer Changes
12.1. The Service Provider may change the Offer terms.
12.2. The new version comes into force from the moment of publication at https://rhizalab.ru/terms.
13. Dispute Resolution
13.1. Parties seek to resolve disputes out of court through negotiations.
13.2. If agreement is not reached, disputes are considered in accordance with RF legislation.
